F45 Training Ealing

1. Access to classes
For health and safety and courtesy to fellow members, we have a maximum one class per day policy. All classes have a cancellation window and fees apply. Review our booking policy.

2. Waiver Form
You agree to sign a waiver form with F45.

3. Suspensions and Expiry Dates
This is an one off payment package that does not have the option to pause. Please note the expiry date for your package.

4. Cooling off period
You can cancel your membership with us up to 14 days from the date you commenced training (for the avoidance of doubt the 14 day period commences from the day you complete your first session with F45). This is only applicable to new membership agreements. If you cancel within the 14 day cooling off period, F45 will refund your money less any set-up fee or the value of any promotional item such as a heart rate monitor F45 have given you upon joining with us.

5. Minimum age
The minimum age for training with F45 Ealing is 18. We may ask for proof of age, to be provided before training with us.

6. Your Health
You warrant that you are in good physical condition and you know of no medical or other reason why you cannot or should not do active or passive exercise. You recognize that the fitness instructor(s) is not able to provide me with medical advice regarding my fitness, and that this information is used as a guideline to the limitations of my ability to exercise.
I agree to not hold any certified trainer or directors of F45 liable for any injury that may occur during an F45 session.

7. Payment
Fees are paid in advance by debit or credit card.

8. Meeting Your Responsibilities
You must make sure:
· your account can accept charges
· there is enough money in your account on the payment day
· you tell us if you are transferring or closing your account at least 72 hours before the next charge
· you tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next charge

9. What happens if your payment is declined or fails for any reason?
If you do not fully pay your fees on the due date, F45 will suspend access to F45 until any outstanding balance has been paid and you have given us your updated card details if they are required. F45 will continue to debit your nominated account without notice, until F45 have received the total amount you owe F45.

F45 will make a reasonable effort to advise you on the status of the failed payments by letting you know beforehand by:
• phoning you
• writing to the email address you provided for membership/s in your name, you must make sure that the payment method you choose remains valid for the length of your agreement. This includes third-party accounts. If the details you give us fail, you are liable for all resulting fees. You should update your details and are obligated to complete your minimum term of payments.

10. Can F45 change your agreement?
F45 may sometimes add to, change or remove our terms and conditions. This includes changing the opening and closing hours, the F45 services and facilities and membership fees. Sometimes, F45 may also close for refurbishment to improve the facilities. If this substantially reduces our ability to provide our service to you, F45 will reduce your membership fees accordingly on a pro-rata basis. The most up-to-date terms and conditions always apply. F45 will give you at least 14 days’ notice of any changes. If F45 do not fulfill our obligations to you, you may be able to cancel your membership. Unless the law states otherwise, you won’t have any other claim against us if this happens.

11. Can F45 increase your fees?
F45 reserves the right to increase your fees only at any time after your agreement has ended. F45 will make a reasonable effort to tell you about this at least 14 days beforehand by writing to the address you last gave us (which may be an email address). F45 will consider that you have received our letter or email on the second business day after it is sent.

Where F45 have made a reasonable effort to let you know about a fee increase, you authorise us to increase any debits from your nominated account.

12. Use of your image
You agree to allow F45 Training to take a video or photo to use for promotion purposes from time to time.

I will adhere to local government guidelines and ensure that I follow the reasonable directions of all F45 staff and trainers in relation to my participation in the F45 training sessions. I will diligently work to keep all equipment and stations clean and I will sanitise my hands upon entering and exiting the studio. I have reviewed and understand the cancellation policy and waitlist process.

By signing below, I hereby acknowledge that I fully understand the above requirements and agree that I will at all times comply with these requirements. I further acknowledge and agree that nothing in this Code of Conduct is intended to limit or otherwise modify the obligations and rights set out in my F45 membership terms and conditions, studio rules and any waivers or releases I have signed in relation to my attendance and use of the F45 Ealing Studio.

F45 Health & Fitness Liability Waiver

I, the participant named below, have agreed to participate in the F45 workouts, exercise and training programs (“Workouts”).

I acknowledge and agree that the Workouts:

- are a recreational sport activity; and
- may involve strenuous physical activity including, but not limited to, muscle strength and endurance training, cardiovascular conditioning and training, and other various fitness activities.

I hereby affirm, and I affirm each time I participate in a Workout, that:

- I am in good physical condition and do not suffer from any known disability or condition which would prevent or limit my participation in this exercise program; and
- I am participating in the Workouts voluntarily and at my own risk.

I hereby release F45 Training Pty Ltd, F45 Ealing and their officers, agents and staff (the “Released Parties”) from any claims, demands, and causes of action as a result of my voluntary participation in the Workouts, to the extent permitted by law.

I fully understand that I may injure myself as a result of my participation in the workouts and I hereby release the Released Parties from any liability now or in the future for conditions that I may obtain directly or indirectly from participating in the Workouts, to the fullest extent permitted by law. These conditions may include, but are not limited to, heart attacks, muscle strains, muscle pulls, muscle tears, broken bones, shin splints, heat prostration, injuries to knees, injuries to back, injuries to foot, or any other illness or soreness that I may incur, including death.

The cancellation window is 8 hours for classes starting before 12 noon and 2 hours for classes starting after 12pm. Should you cancel or not show for a class, fees are strictly applied. Late cancel fee is £5 and No Show £15. These are processed the day after the class it relates to.
Should you be on a waitlist and decide you no longer can attend the class, you need to cancel your booking to avoid a fee. If you are on a Waitlist you will be automatically moved and immediately confirmed on the class when a space becomes available. No notifications are sent, please refresh and review your F45 app for change in status.

I will bring a sweat towel to every class and be in the studio, on the blue track before the class starts to participate in the class.
